What the Writer Says…
BA30 is the endorsement code for attempting to drive while disqualified by order of court. It carries the same penalties as BA10 (driving while disqualified) - 6 points, a fine of up to 5,000 pounds, and up to 6 months in prison. Under the Criminal Attempts Act 1981, "attempting" means doing an act that is more than merely preparatory to driving, such as sitting in the driver's seat with the engine running or being found with keys in the ignition about to pull away.
The prosecution must prove three things: that you were disqualified by order of court, that you did something more than merely preparatory to driving, and that you intended to drive on a road or public place. Simply sitting in a parked car or carrying car keys is not enough to constitute an attempt.
