What the Writer Says…
DD90 is one of the more unusual endorsement codes on the DVLA register. It records a conviction for furious driving under Section 35 of the Offences Against the Person Act 1861 - an Act that predates the modern Road Traffic Act by over a century.
The offence covers "wanton or furious driving or riding" that causes bodily harm to any person. It was originally written to cover horse-drawn carriages, but it remains on the statute books and is still used today. Courts sometimes apply it to cyclists, because the Road Traffic Act 1988 applies only to "mechanically propelled vehicles" and cannot be used to charge a cyclist with dangerous driving.
